The Law Commission following in the footsteps of the Soviet Union's Stalinist authorities? A cautionary tale!

I came across this letter in The Week (November 14) which illustrates what may happen if the Law Commission’s proposals on hate speech come to pass.  And they say an Englishman’s home is his castle!

The Law Commission’s proposal to extend the jurisdiction of hate speech to private homes has unhappy parallels.  In 1932 Soviet, propaganda had it that a 13-year-old dedicated Young Pioneer, Pavlik Morozov, did the “right thing” by denouncing his father, Trofim, to the Stalinist authorities.  Trofim was said to have been executed as a result.  Members of Pavlik’s family, somewhat unhappy with this, then murdered the youth.  In turn they themselves were executed.  Pavlik was lauded in the USSR as a martyred hero, an example for Soviet youth to follow.

A single Lance Corporal, Soldier F, charged over Bloody Sunday while senior officers and politicians walk away scot-free.


Soldier F, a paratrooper in his seventies, faces murder charges over the killing of two people at a civil rights march in Londonderry on 30 January 1972 when the First Battalion Parachute Regiment was ordered to police the event.  He held the rank of Lance Corporal at that time.

Soldier F joined the Parachute Regiment in 1966 and left the army in 1988 as a Regimental Sergeant Major after a distinguished career which included a long spell in Special Forces.

It strikes me as typical that the British military and political establishment are allowing a single NCO to carry the can for Bloody Sunday while senior officers and politicians of that era escape the consequences of their orders to enjoy a comfortable retirement with their pensions, peerages and knighthoods.  They were fully aware that the Parachute Regiment was a highly trained and aggressive assault unit, so which military genius thought it would be a good idea for them to police a civil rights march?

On Friday last thousands of bikers, many of them ex-servicemen, protested against the treatment of Soldier F by staging a mass ride-out in Central London.  I say: “Good for them!”

Robin Tilbrook, Chairman of the English Democrats, bids to prove in the High Court that the UK has already left the EU.


Robin Tilbrook, Chairman of the English Democrats, is using the Gina Miller case to show that the United Kingdom has left the European Union and that the Prime Minister had no legal authority to extend Article 50 without an Act of Parliament.  He has served papers, in person, to the High Court suggesting that the UK has already left the EU which, if upheld in court, would mean that the government is proceeding with negotiations as if we are still members when in fact we left on 29 March.   

Sir Richard Aikens, a former appeal court judge, has previously said that the legality of Theresa May’s delay to Brexit should be tested in court.  It will be interesting to see if those in the British legal establishment find any illegality with the British political establishment’s Brexit shenanigans.

Putting British soldiers on trial. The Week's letter of the week.



Consider the treatment of these three servicemen.

Sgt Alexander Blackman, Royal Marines, spent 1,277 days behind bars for shooting a mortally wounded Taliban fighter in Afghanistan.

Major Robert Campbell, Royal Engineers, faced eight investigations into the death of an Iraqi 15 years ago.


75 year old former Guardsman Dennis Hutchings faces court over a death in Northern Ireland 44 years ago.


Little wonder that Johnny Mercer MP, a former captain in the Royal Artillery, commenting on the British Government’s approach to such matters said: “The current system is perhaps the worst betrayal of servicemen by the political leadership of any country anywhere on earth, and it is happening in Britain today.”


Now reflect on this letter in The Week(June 30), which first appeared in The Daily Telegraph, and decide if the three pillars of the British Political Establishment; the Conservatives, Labour and Liberal Democrats are guilty of “double standards” and “betrayal”. 



Putting soldiers on trial.

Another soldier is to be prosecuted for events that took place in Northern Ireland decades ago. 
I served in Northern Ireland during the 1970s and 1980s, and recently added my name to a petition addressed to the Government entitled “British soldiers who served in Northern Ireland must have immunity from prosecution”.  The Government’s written response stated that prosecutions were a matter for the police and the prosecuting authorities, who acted independently of the Government.  The paragraph ended: “We do not support amnesties or immunity from prosecution.”
This sentence encapsulates the double standards that exist in dealing with immunity: the government of the day acted contrary to the present policy when it made a political decision to allow an amnesty and immunity for hundreds of convicted felons under the Good Friday Agreement.
This is what people in the military find impossible to swallow.  How could any British government do a deal to draw a line under the conflict without ensuring that their own servants, who had given them enough breathing space to achieve a political peace, were treated in the same way as the criminal protagonists?
It’s time for this Government to put the matter right once and for all.

"I am going to curtail alien immigration and deport undesirables", said the Conservative Home Secretary - in 1924!


Robin Tilbrook, Chairman of the English Democrats, has posted an interesting article on his blog comparing what an English Conservative Home Secretary said about immigration in 1924 to the views of today’s Tory leadership.

Mr Tilbrook reveals Sir William Joynson- Hicks, Conservative Home Secretary in 1924, said:

“I am going to curtail alien immigration and deport undesirables; we do not want to flood England with the alien refuse of the world.  I regard aliens who live in their own communities, marry within them, and speak their own language, as unsuitable to be British residents.”

The English Democrats Chairman writes:

“Of course in those days Conservative Home Secretaries were proper Conservatives and were also patriots who would be revolted by the current Home Secretary’s unpatriotic support for foreigners ruling over us through the EU.”

Meanwhile, it seems one Conservative, Rory Stewart the Minister of State for International Development and Minister of State for Africa at the Foreign and Commonwealth Office, might have one or two thoughts along the same lines as Sir William Joynson-Hicks.

Mr Stewart, speaking of British Isil fighters, was quoted in The Telegraph saying:

“They are absolutely dedicated, as members of the Islamic State, towards the creation of a caliphate, they believe in an extremely hateful doctrine which involves killing themselves, killing others and trying to use violence and brutality to create an eighth century, or seventh century, state.

So I am afraid we have to be serious about the fact these people are a serious danger to us, and unfortunately the only way of dealing with them will be, in almost every case, to kill them.”

Doubtless British Isil fighters could be classed as “undesirables” but, if they somehow managed to return to these shores, could they be deported?   They are, after all, British and which nation would want to take in British “undesirables"?

Robin Tilbrook, Chairman of the English Democrats, gives his view of "British values" in his speech at the party's annual conference.


Here is the section of Robin Tilbrook's speech which refers to the Conservative Government's view of "British values".

"The Government’s position is now that anybody who doesn’t subscribe to their definition of fundamental “British values” is automatically an extremist. So let’s examine what you have to sign up in order not to be an extremist according to the Gospel of Mrs May. Here is their definition of fundamental British values: -


The fundamental “British values” are: - of democracy, the rule of law, individual liberty, and mutual respect and tolerance of those with different faiths and beliefs.”


Ladies and Gentlemen let us just go through this carefully with a lawyer’s eye to analysing the definition. Obviously by definition any English nationalist such as all of us here in this room will not subscribe to fundamental “British” values.


Ignoring the point that naturally if you were a Scottish nationalist or a Welsh nationalist in Scotland or Wales it wouldn’t be suggested that you should have to subscribe to British values, since they are allowed their own Nations! We are not!

But the definition of Theresa May’s so called “British values” goes further than that. This definition means that you couldn’t even be a biblically inspired Christian because you couldn’t subscribe to these fundamental British values if you believe what Christ says:- “I am the way, the truth, and the life: no man cometh unto the Father, but by me” then they define you as an “extremist”."

Robin Tilbrook,Chairman of the English Democrats,heeds his own advice to report an anti-English "hate crime".

Robin Tilbrook, Chairman of the English Democrats, recently posted on his blog an article in which he gave advice on reporting to the police any so-called “hate-crimes” perpetrated against anyone English.  It appears he has taken his own advice and reported Nicholas Boyle, a Cambridge University professor, to the police for calling the English the “lager louts of Europe”.  Professor Boyle made the comment, and others in similar vein, in an article for New European bemoaning the fact that 17 million English voted for Brexit.

Incidentally, if I was Welsh I would not be entirely happy for Wales to be described as an “English appendage” when Professor Boyle states: “The pattern of voting showed up a colossal divergence between England, with its Welsh appendage, on the one hand, and Scotland and Northern Ireland on the other.” 

Robin Tilbrook’s action over Professor Boyle was reported and commented on by the Daily Mail and Daily Express.

Hate crimes against the English. Robin Tilbrook, Chairman of the English Democrats, offers some advice.

Robin Tilbrook, Chairman of the English Democrats, offers some advice to those English who have had hate crimes perpetrated against them. 
I quote below, from his blog, a couple of paragraphs on anti-English so-called "hate crimes":

"These always ought to be reported. If a police officer shows any reluctance to accept it as a “hate crime” then a complaint should be made against the officer concerned. The complaint should be taken as far as it can up the Police Forces' complaints system so that it gets into the records that a lot of the “hate crime” is perpetrated against the English rather than by them.

Equally no opportunity should be lost to insist that you are “English” on ethnic monitoring forms rather than permitting yourself to be put down as “British” which is a legally invalid category and therefore waives your rights and your community’s rights under the Equality Act.

I could of course give many other examples of where we need to make sure that we do pull our weight, but I am sure you get the point! But don’t be put off by any official discouragement!"

English Votes on English Laws. Professor John Curtice says: "The English were sold a pup".


A devastating article by Nick Gutteridge  in the Daily Express (December 2) illustrates the ineffectiveness of former Prime Minister David Cameron’s policy of English Votes on English Laws.  The policy was rushed forward after the 2014 Scottish Referendum in order to assuage growing English concern over Scottish politicians’ interference in English domestic affairs.

Here are some quotes from the article:

Professor John Curtice, a political expert at Strathclyde University, recently told a debate on the usefulness of EVEL: “the English were sold a pup”.


A damning report published by the London School of Economics (LSE) concluded that the flagship measure has “done little to facilitate the expression of English voice” and that it is “unhelpfully complicated and opaque”.


Mr Cameron’s boast: “We have heard the voice of Scotland, now the millions of voices of England must be heard.” 

The Campaign for an English Parliament blasted: “We now know that statement wasn’t true. It was a lie. 

The campaign’s director, Eddie Bone, added: “The only way the English are going to stop their taxes being unfairly given away to Scotland, Wales and Northern Ireland is by having a clearly defined voice and that can only be enabled by an English parliament.”

Police response to petrol theft ("drive-offs") from filling stations. Letter in the Western Daily Press, June 30th, 2015.

To pursue or not to pursue?  The bizarre world of British justice!  This letter was published in the Western Daily Press on June 30th.

Our judicial system needs common sense.

Devon and Cornwall Police no longer consider driving away from a petrol filling station without paying as a theft worth investigating, even though it is apparently the most reported crime in the countryside. It seems lack of funds brought about this new policy.

Meanwhile, at the other end of England in North Yorkshire, where petrol theft is still considered worthy of interest to the police, a conscientious and determined police officer gave chase when he saw a man drive off from a petrol station without paying. After a three-mile pursuit by car and on foot the officer caught the culprit who was eventually jailed for theft.

Was the officer commended for his actions? Evidently not; in a ludicrous turn of events he was put on trial for dangerous driving! Unsurprisingly, a jury quickly found him not guilty.

A dose of common sense needs to be injected into the bizarre world of British justice. Money should not be wasted on prosecuting police officers in Yorkshire when they are obviously doing what is expected of them. It would be better spent on making resources available to pursue petrol thieves in Devon and Cornwall.

Immigrants, cultural context and the Law

In her ruling the judge said: "Proper allowance must be made for what is, almost certainly, a different cultural context."

I entirely agree with Clive Lavelle's letter in the Western Daily Press on December 1st 2014 which although referring to a different case is just as pertinent.  


Behaviour is not part of our culture

Back in February 2011, you published a letter from me in which I said that I am all in favour of a multi-racial England, but that immigrants should adapt to English customs and culture, and not expect the locals to adapt to theirs.

On Points West, the other night, I learned about the conviction of three Somali men who abused and raped girls as young as 13. They claimed that this behaviour was part of their culture.

Well, it is not part of ours.
